The application of the Environmental Sanitation Law (DSA) 2020 in Cozumel for visitors arriving by sea

begins March 2 2020

Last December, in order to contribute to the sustainability of the municipality, the State Congress of Quintana Roo, approved to apply the collection of Environmental Sanitation Law to those who arrive in Cozumel by sea.

The application of the right to visitors arriving by sea to the municipality will begin on March 2 of the current year, with the exception of those who live or work in Cozumel, and people that travel o the island in the performance of their professional task.

For people who remain less than 24 hours in the municipality, the law is equivalent to 15% of the value of the daily U.M.A. (Unit of Measurement and Update ) per person ($ 13 pesos per person).

Users of hotel rooms, guest houses, hostels and motels will continue to pay 30% of the value of the U.M.A. daily per room per night occupied.

Cozumel is one of the main tourist destinations of the Riviera Maya and first place of the cruise industry in the Caribbean. Annually receives more than five million tourists who stay less than 24 hours on the island.

The municipality appreciates the cooperation of the companies dedicated to the transport of people and goods -in this case, of the companies that handle ferries- in the charge process of the DSA that tourists who pay for their services must pay.

Cozumel City Council deeply values the spirit of collaboration that shipping companies have shown in relation to this tax and their positive response to act as auxiliaries in strengthening municipal public finances in their double role as retainers and as responsible for knowing the product of that lien.

What is the law for?
The DSA has a priority objective: to ensure that all visitors to the island contribute to the preservation and sustainability of the tourist destination.

What is its legal basis?
Articles 135 BIS, 135 TER, 135 QUATER, 135 QUINQUIES, 135 SEXIES and 135 SEPTIES of the Treasury Law of the Municipality of Cozumel, of the State of Quintana Roo.

How does the law change?
During 2019 tourists who spent a night or more in Cozumel already paid the Right. As of 2020, tourists who are less than 24 hours on the island will also pay

When does it take effect?

Who is the Subject of Law

What is the amount of the right?
For people who remain less than 24 hours in the Municipality, the Law is equivalent to 15% of the value of the U.M.A. daily (currently $ 13) per person. Users of hotel rooms, inns or guest houses, hostels and motels will continue to pay 30% of the value of the U.M.A. daily (currently $ 26.06) per room per night occupied.

Will people who live or work in Cozumel pay more to cross in Ferry?
No. The Law clearly states that people who demonstrate that they live or work on the island and crew members are not subject to paying the Law.

What is the use of the money raised?
The resources will be used in environmental sanitation, public safety, civil protection and other actions that contribute to the sustainability of Cozumel as a tourist destination.

What mechanisms are there for proper administration?
At the beginning of 2019, the Citizen Monitoring Committee was established to monitor the collection of these resources. The Committee is made up of citizens representing the main social and productive sectors established in the Island.

Who retains it?
Hotels, inns or guest houses, hostels and motels of the Municipality of Cozumel, ferry companies, cruise ships, and port terminals.

Who declares it?
The moral persons that retain the Law. In the case of visitors arriving on cruise ships, and in accordance with the mechanism agreed by the parties, it will be the port terminals that will have to inform the public treasury of the amount corresponding to the rights retained by the shipping companies, after having received them from the visitors

When is it declared?
At the latest on the 15th of the month immediately after collection.

How do you declare?
By means of a printed format that can be obtained in the Municipal Treasury or on the official page of the Municipality, presenting it at the window of the Revenue Department within the deadlines established by Law.
